Terms and Conditions

Article 1 General

1.1 Snuff Bottle Collection is entered in the Trade Register under number 82770476 and its registered office is located at Strandweg 45 in Burgh Haamstede, the Netherlands.

1.2 These general terms and conditions apply to all offers, orders and agreements extended by or participated in by Snuff Bottle Collection.

1.3 By placing an order, you are indicating your agreement with the delivery and payment conditions. Snuff Bottle Collection reserves the right to amend its delivery and/or payment conditions after the term of an agreement has expired.

1.4 It is possible to deviate from the provisions of these general terms and conditions only in the event this has been expressly agreed in writing and in which case all remaining provisions of these general terms and conditions shall remain in full force.

Article 2 Delivery and Returns

2.1 The delivery destination shall be the address provided to Snuff Bottle Collection by the customer when placing their order. In most cases, this address will have been provided via the website, during the checkout process.

2.2 Delivery to a destination within the Netherlands shall take place within two to four weeks, unless otherwise indicate on the website.

2.3 All delivery terms stated on the website are indicative only. As such, no rights may be derived from the aforementioned terms.

2.4 Any payment(s) previously submitted by the customer shall be refunded to the customer’s bank or giro account as soon as possible, but in any case within fourteen (14) working days after Snuff Bottle Collection has received a request to terminate the agreement (as referred to in Article 2, section 6).

2.5 After the customer has received the article they ordered, the customer is entitled to dissolve the underlying agreement with Snuff Bottle Collection within fourteen (14) days after receipt of this article if they so desire. The customer is not required to give a reason for this.

2.6 In the event the customer wishes to dissolve the agreement in accordance with article 2, section 5 of these General Terms and Conditions, the customer must return the article in the original and undamaged packaging, after having notified Snuff Bottle Collection, to an address specified by Snuff Bottle Collection. In such cases, the customer shall themselves bear the costs and risks of shipping.

2.7 In the event that the customer has revoked the agreement with Snuff Bottle Collection pursuant to Article 2, section 5 of these General Terms and Conditions, and – at such time – the customer has previously submitted payment(s), Snuff Bottle Collection will refund that/those payment(s) to the customer within fourteen (14) working days from the date on which Snuff Bottle Collection receives the item returned by the customer. In such cases, Snuff Bottle Collection will deduct the original shipping fees from the amount to be credited.

2.8 Snuff Bottle Collection reserves the right to refuse returned items or to issue only a partial refund of the amount paid if it is suspected that the item has been opened or used, or has been damaged through the fault of the customer (as opposed to that of Snuff Bottle Collection or the supplier of the item).

2.9 If, in the opinion of Snuff Bottle Collection, a returned item has incurred damage that can be attributed to an act or negligence on the customer’s part, or for which the customer is otherwise responsible, Snuff Bottle Collection will inform the customer of this in writing by post or email. Snuff Bottle Collection is entitled to deduct the amount by which the value of the article has depreciated as a result of this damage from the amount to be refunded to the customer.

Article 3 Payment and Shipping

3.1 All prices stated on the website are in euros and include statutory sales tax (VAT of 21%) and are exclusive of shipping fees.

3.2 Prices will not be increased within the term of the offer, unless statutory measures make this necessary or in the event the manufacturer has implemented an interim price increase.

All prices on the website are subject to printing and typographical errors. Snuff Bottle Collection accepts no liability for the consequences of printing and typographical errors.

3.4 Orders will be dispatched only after payment is submitted in advance. Payment may be submitted via iDeal, PayPal or credit card.

3.5 Within the Benelux region, the shipping fee for images up to 100x180x50 cm is €20 per item. Within the Benelux region, the shipping fee for images larger than 100x180x50 cm is €35 per item. Quotes for shipping fees to destinations outside the Benelux available upon request.

3.6 For orders that can be mailed as so-called letter post, the shipping fees charged will be adjusted accordingly.

3.7 Once payment has been received, all orders will be dispatched within three working days.

3.8 All orders will be shipped via PostNL, UPS or DHL.

3.9 If a purchase is made from outside the country of dispatch, the customer shall bear sole responsibility for any applicable sales tax or import duties.

Article 4: Guarantees

4.1 Snuff Bottle Collection guarantees that all delivered items shall correspond to the terms of the agreement and meet the specifications stated in the offer, and thus guarantees the manufacturer’s warranty on the item delivered to you.

4.2 The term of the warranty extended by Snuff Bottle Collection is identical to the term of the factory warranty. This warranty is void in the event a defect is due to 1) insufficient care, 2) intentionally inflicted damage or 3) carelessness or negligence.

Article 5: Price quotations

5.1 Price quotations are free from obligation unless otherwise stated in the quotation.

5.2 Upon acceptance of a non-binding offer by the customer, Snuff Bottle Collection reserves the right to revoke or deviate from the offer within the period of three working days following receipt of that acceptance.

5.3 Snuff Bottle Collection shall be bound by verbal commitments only after these have been explicitly confirmed in writing.

Article 6: Agreement

6.1 An agreement between Snuff Bottle Collection and a customer shall arise only after Snuff Bottle Collection has assessed the feasibility of the order or request in question.

6.2 Snuff Bottle Collection reserves the right to reject any orders or requests without further explanation, or to accept them exclusively on the condition that advance payment is submitted prior to dispatch.

Article 7: Images and specifications

7.1 All images, photos, drawings, etc., as well as technical and other specifications – e.g., information on weights, dimensions, colours, etc. – found on the Snuff Bottle Collection website are intended as an approximation only; these are indicative and cannot constitute grounds for compensation or termination of the agreement.

Article 8: Force majeure

8.1 Snuff Bottle Collection cannot be held liable in the event and insofar as its commitments cannot be fulfilled as a result of force majeure.

8.2 Force majeure is understood to mean any and all external causes, as well as any circumstance for which Snuff Bottle Collection cannot reasonably be held responsible. Delays due to our suppliers or non-performance thereof, transport difficulties, strikes, government measures, delays in the supply, negligence on the part of suppliers and/or manufacturers for Snuff Bottle Collection or that of any auxiliary persons, employee illness and defects in auxiliary or transport equipment are expressly regarded as force majeure.

8.3 In cases involving force majeure, Snuff Bottle Collection reserves the right to suspend its obligations and is entitled to dissolve the agreement, either wholly or in part, or to demand that the content of the agreement be amended in such a way that execution remains possible. Under no circumstances shall Snuff Bottle Collection be held to pay any penalty or compensation for damage.

Article 9: Communication

9.1 Snuff Bottle Collection is in no way whatsoever liable for any misunderstandings, damage, delays or unclear transmission of orders and communications as a result of the use of the internet or any other means of communication in the traffic between the customer and Snuff Bottle Collection, or between Snuff Bottle Collection and third parties, insofar as these concern the relationship between the customer and Snuff Bottle Collection.

Article 10: Complaints procedure

10.1. All complaints related to the delivery, quality or nature of an item, as well as any other complaints, will be processed by Snuff Bottle Collection with due seriousness.

10.2 Customers must submit any complaints to Snuff Bottle Collection in writing.

10.3 Snuff Bottle Collection shall make every attempt to resolve the issue within seven working days. Snuff Bottle Collection will apprise the customer of this in writing.

Article 11: Intellectual and industrial property rights

11.1 The customer must fully and unconditionally respect any and all intellectual and industrial property rights attached to the goods delivered by Snuff Bottle Collection.

Article 12 Miscellaneous

12.1 In the event the customer has provided an address to Snuff Bottle Collection, Snuff Bottle Collection is entitled to dispatch any and all orders to that address until such time as the client has provided Snuff Bottle Collection with a new address.

12.2 Snuff Bottle Collection is authorised to make use of third parties when fulfilling the customer’s order(s).

Article 13 Applicable law and disputes

13.1. All offers, orders and agreements extended by or participated in by Snuff Bottle Collection shall be governed exclusively by Dutch law.

13.2 Any and all disputes which may arise in connection with an agreement between Snuff Bottle Collection and the customer, and which said parties are unable to resolve in mutual consultation, will be exclusively brought before the competent court in the district of Rotterdam, the Netherlands.
